Michelman & Robinson Paves the Way Firm Client Shadow Pines Can Now Proceed With Planned Residential Development

Michelman & Robinson, LLP’s (“M&R”) is pleased to announce its recent victory in an easement dispute that had long compromised development of a planned residential community. After a five day trial, the Superior Court of California for the County of Los Angeles found in favor of the defendant Shadow Pines (“Shadow”) on the Ejectment, Quiet Title and Declaratory Relief causes of action. Windsor Pacific LLC vs. Samwood Co. Inc., et al., Case No. PC046686.

Windsor Pacific (“Windsor”) is a neighboring landowner to Shadow, a joint venture that includes among others, homebuilder, Brookfield Homes, in a rural part of Canyon Country. In mid-2005 Windsor and Shadow entered into an agreement to work together regarding their proposed neighboring developments. Following some unexpected delays with the County of Los Angeles, Windsor moved to renegotiate its agreement with Shadow, forcing Shadow to contractually terminate the agreement with Windsor. On February 12, 2009, Windsor filed a lawsuit against Shadow claiming public and private prescriptive easements over Shadow’s land. A granting of any such easement would have challenged Shadow’s approved planned residential development of nearly 500 homes.

Windsor, who relied largely on paid experts, claimed that Windsor, Windsor’s own agents and neighbors had used the dirt roads in question for the necessary 5 year timeframe to earn prescriptive easements over Shadow's land. Conversely, M&R partner, Eric J. Rans and his team provided testimony from numerous local residents and unbiased witnesses to contradict Plaintiff’s overall theme and testimony.

Shadow’s legal team, which included M&R associates David J. Williams and Stephen R. Isbell in addition to Mr. Rans, proved that Shadow had previously provided Windsor permission to use the roads in question and that Windsor had failed to meet the high burden of proof to be awarded the easements.

Irvine, CA., - Despite the tough economic climate, this year’s Building Industry Show “BIS” aims to get the housing industry “bouncing back” by totally reinventing the BIS Trade Show experience. The 2010 BIS Tradeshow will be held at the Long Beach Convention Center on November 18 & 19. With an expected attendance of 4,500 people and over 200 exhibitors, the BIS show is the largest Southern California tradeshow of its kind. This year BIS will be featuring a variety of educational seminars, workshops and no holes-barred lively discussions.

On Thursday November 18th the 44th Annual BIA/SC Awards and Installation Breakfast will be held at the Hyatt Regency hotel in Long Beach. This prestigious event is for friends, associates, and building industry innovators to honor BIA/SC President, Michael Vairin, Builders Development Group Inc. The workshop will be covering what you need to know about building in California. One exciting change is the redesigned exhibit floor plan, which will be offering attendees and exhibitors a new and exciting tradeshow experience with several new activity hubs spread throughout the show floor. One of those new hubs will be the Green Pavilion, which will feature a theater dedicated to informative seminars on new green codes, innovative green building solutions and products. This Year’s Building Industry Trade Show Builder Breakfast to host some of the Industry’s Biggest Names

IRVINE, California - This year’s Building Industry Show “BIS” is rebooting the whole show experience to get the housing industry bouncing back. One exciting change is the new Big Builder Breakfast which will host speakers who will reveal their insight on how to re-emerge as leaders and innovators in the current economic climate. In addition, the breakfast will be a great opportunity for attendees to expand their contacts with executive builders. Guest speakers will include: Mick Pattinson, CEO, Barratt Group; Adrian Foley, President, Brookfield Southland Holdings; Larry Webb, Partner, The New Home Company; and Liesel Cooper, President, KB Home Arizona. The breakfast program will be held on day 2 of the trade show, Friday November 19th from 9:00am – 10:30am.
